Welcome to the Aqua Jet Pools website. Aqua Jet Pools (“we,” “us,” or “our”) provides professional swimming pool service and construction services, including pool maintenance, repair, renovation, and new construction (“Services”). By accessing or using our website or Services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree with any part of these Terms, you should not use this website or our Services.
These Terms apply to all visitors, customers, and others who access the site. We reserve the right to update or modify these Terms at any time. Any changes will be effective immediately upon posting to the website. It is your responsibility to review these Terms periodically for updates. Your continued use of the site after changes are posted constitutes acceptance of the revised Terms.

By agreeing with the terms of this Privacy Policy and opting-in to receive informational messages (appointment reminders, account notifications, etc.) from Aqua Jet Pools. Message frequency varies. Message and data rates may apply. For help, reply HELP or email us at info@aquajetpools.com. You can opt out at any time by replying STOP. This includes, but is not limited to, telemarketing messages via phone call and SMS/text messages regarding promotions, appointments, reminders, or services. Consent to receive marketing messages from Company is not a condition of purchasing Company’s products or services. Your consent to receive text messages is voluntary and not a condition of purchasing any goods or services.
You agree this consent applies to the specific phone numbers you provide to us or numbers we can reasonably associate with your account (through skip trace, caller ID capture or other means which may be described in this Privacy Policy). You represent that the telephone number(s) you have provided to us or will provide to us in the future are your contact numbers and that you will promptly alert us when a particular telephone number is no longer associated with you.
Standard message and data rates may apply as determined by your mobile carrier. You can opt out of receiving further text messages at any time. To unsubscribe, reply STOP to any Aqua Jet Pools message or click an available unsubscribe link (if provided in a message). You may also text HELP for information or assistance regarding our text message program. We will not charge you for enabling or disabling text messages, but you are responsible for any messaging or data fees from your mobile provider.
Aqua Jet Pools will not share or disclose your phone number to third parties for their marketing or promotional purposes. Your contact information will be used only for Aqua Jet Pools communications and as otherwise described in these Terms and our Privacy practices.
Verbal SMS Opt-In Policy
Aqua Jet Pools also offers a verbal opt-in for SMS notifications, which may be collected in person or over the phone. When you engage our Services or register as a customer through our staff, our representative will ask if you wish to opt in to receive text message updates. As part of this verbal opt-in process, we will request your mobile phone number and ask for your consent to receive SMS notifications for purposes such as billing alerts, appointment reminders, service dispatch notifications, and post-service completion surveys.
Our staff will clearly inform you of the SMS program details at the time of opt-in, including the fact that message and data rates may apply, and that message frequency may vary based on your service activity or inquiries. You will be told that you can text HELP for help or STOP at any time to cancel future messages. We also clarify during this verbal sign-up that providing your phone number for text messages is optional and not required to receive our Services, and that Aqua Jet Pools will not share your phone number with any third party for marketing purposes. By verbally agreeing to opt in, you acknowledge and consent to receive text messages under these same terms. All other provisions of our text message program (such as the ability to unsubscribe at any time and our privacy protections for your number) apply equally to a verbal opt-in.
Limitation of Liability
To the fullest extent permitted by law, Aqua Jet Pools and its owners, officers, employees, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or relating to your use of this website or our Services. This includes, without limitation, any errors or omissions in content, any downtime or availability issues, any reliance you place on the information provided on the site, or any damages to your computer system or data due to viruses or other harmful components obtained through the site.
Aqua Jet Pools’ total liability for any claim arising from or related to use of the website or Services is limited to the amount (if any) you paid to Aqua Jet Pools for the use of our Services in the past six months, or $100, whichever is greater. Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full. In such cases, our liability will be limited to the maximum extent permitted by applicable law.
By using the site or Services, you understand and agree that your use is at your sole risk. The website and all content and Services provided through it are offered on an “as is” and “as available” basis without warranties of any kind. Aqua Jet Pools disclaims all warranties, express or implied, including any implied warranties of accuracy, non-infringement, merchantability, or fitness for a particular purpose. You agree that Aqua Jet Pools shall not be liable to you or to any third party for any modification, suspension, or discontinuation of the site or Services.
Privacy and Data Use

However, no method of transmission over the internet or electronic storage is 100% secure, so we cannot guarantee absolute security. Maintenance & Service Terms & Conditions
These Terms apply to all pool opening, closing, repair and maintenance services (“Services”) provided by Aqua Jet Pools (“Aqua Jet”) to the customer (“Customer”). By scheduling or accepting Services, the Customer agrees to these Terms.
1. Services & Scope: Aqua Jet provides pool opening, closing, maintenance & repair services as outlined in the applicable work order. Pool openings and closings do not include cleaning or vacuuming unless stated in writing. Aqua Jet does not clean or store winter covers. Work outside the standard scope (repairs, troubleshooting, extra cleaning, chemicals, or labor) is billed at standard rates plus parts. Additional labor charges apply if winter covers have more than 12” of water or automatic covers require draining.
2. Labor Rates: unless otherwise agreed labor rates are $189 for the first hour, $150 per additional hour, plus parts and materials. Rates may change with reasonable notice.
3. Water Level & Drainage: The Customer is responsible for maintaining proper water levels at all times. Aqua Jet is not responsible for damage caused by low water levels or dry-running equipment. Aqua Jet will not add water unless agreed in writing and additional charges apply. If water must be drained, the Customer must provide a legal discharge location and assumes all regulatory responsibility. Aqua Jet is not responsible for fines, penalties or property damage related to water discharge.
4. Pool Surfaces: Aqua Jet is not responsible for inherent risks or conditions that become visible during or after service, including but not limited to: 1) Vinyl liner wrinkling, floating, fading, shrinking, or tearing 2) Staining, etching, leaching, or discoloration of gunite, marcite, or fiberglass. Customers acknowledge inherent risks with vinyl liner pools. Aqua Jet is not responsible for vinyl liner tears or leaks resulting from services rendered. All surface-related risks are assumed by the Customer.
5. Routine Maintenance & Chemicals: Routine maintenance may include vacuuming, skimming, basket cleaning, filter upkeep, water testing, and chemical balancing. Chemicals are added as needed and are billed separately unless included in a seasonal service contract. Customers must submit a written request to decline chemical service.
6. Payments & Auto-Charge: Pool openings & closings must be prepaid. All balances must be paid in full prior to service. A valid credit card number is required for any recurring services. Unpaid balances after 30 days may be automatically charged to the card on file and services may be suspended for non-payment. A late fee of 2% may be applied to payments over 30 days past due.
7. Access & Accuracy: The customer must provide safe, timely access to the pool/spa area including securing pets and providing access instructions. Electricity must be available. If incorrect details (size, type, equipment, access to facility or electric) result in additional labor or materials, additional charges may apply.
8. Scheduling & Cancellations: Scheduling is subject to routing and capacity. Aqua Jet reserves the right to reschedule. Cancellations require 48 hours’ written notice to sales@aquajetpools.com. Failure to cancel or provide access may result in the visit being billed.
9. Liability: Aqua Jet’s liability is limited to the amount paid for the specific service. Aqua Jet is not responsible for pre-existing conditions, hidden defects, improper installation, or conditions between visits.
10. Governing Law: These Terms are governed by the laws of the State of New York.
