19. Entire Agreement
These Terms constitute the entire agreement between you and Aqua Jet Pools regarding website use and services.
By using this website or submitting information, you acknowledge that you have read and agree to these Terms.
Maintenance & Construction Terms of Service
These Terms & Conditions apply to all pool maintenance, repair, liner replacement, and construction services (“Services”) provided by Aqua Jet Pools (“Contractor”) to the customer (“Customer”). By approving any proposal, estimate, or invoice, the Customer agrees to these Terms.
1. Scope of Work: Contractor agrees to furnish labor and materials as outlined in the approved proposal or work order. Any work outside the defined scope—including repairs, additional labor, materials, or unforeseen conditions—will be billed at standard rates plus materials.Completion of work is subject to weather, material availability, site conditions, and other factors beyond Contractor’s control.
2. Scheduling & Access: Scheduling is subject to routing, labor availability, and weather conditions. Completion dates are estimates only and are not guaranteed. Customer must provide safe and timely access to the pool area, including securing pets and ensuring access to utilities (water and electricity). Missed appointments or lack of access may result in additional charges.
3. Payment Terms: Unless otherwise specified:
- Maintenance services may require a valid credit card on file for recurring billing
- Openings and closings must be prepaid
- Liner replacements: 50% deposit, 50% due upon installation
- New construction:
- 10% upon contract execution
- 20% upon permit approval
- 40% upon excavation
- 25% upon equipment installation
- 5% upon liner/plaster installation
Balances unpaid after 30 days are subject to a 1.5%–2% monthly finance charge. Contractor reserves the right to suspend services for non-payment. All materials and equipment remain property of Contractor until paid in full.
4. Services & Maintenance: Routine maintenance may include vacuuming, skimming, filter service, and chemical balancing. Chemicals are billed separately unless otherwise specified. Customer is responsible for maintaining proper water levels at all times. Contractor is not responsible for damage caused by low water levels or improper operation of equipment. Openings and closings do not include cleaning or vacuuming unless specified in writing. Additional labor charges may apply for excessive debris, water on covers, or abnormal conditions.
5. Liner Replacement Services: Liner replacement includes draining the pool, removing the existing liner, and installing a new liner. Minor base preparation is included; structural or floor repairs are additional. Debris will be placed in a designated location; disposal is the Customer’s responsibility. Liners are special-order items and are non-refundable. There is a minimum charge of $3,500 for groundwater management or adverse conditions; additional charges may apply.
6. Construction & Site Conditions: Customer is responsible for obtaining all required permits, approvals, and inspections unless otherwise agreed in writing. Customer must ensure proper site access for equipment. Contractor is not responsible for damage to lawns, landscaping, driveways, or surrounding areas resulting from normal construction activity. Unforeseen conditions—including rock, groundwater, unstable soil, or drainage issues—may require additional work at additional cost. Customer is responsible for site drainage and compliance with local codes.
7. Exclusions: Unless explicitly included in writing, Services do not include:, Landscaping, grading, or restoration, Decking, fencing, or site improvements, Electrical or plumbing work (unless specified), Repairs to pool structure, surfaces, or equipment, pool / patio cleaning and/or chemicals.
8. Water Use & Drainage: Customer is responsible for providing water for filling or refilling the pool and for all associated costs. If water must be discharged, Customer must provide a legal discharge location and assumes all responsibility for compliance with local regulations. Contractor is not responsible for fines, penalties, or damage related to water discharge.
9. Surface & Material Conditions:
Customer acknowledges inherent risks associated with pool surfaces, including but not limited to:
- Vinyl liner wrinkling, shrinking, fading, or tearing
- Cracking, staining, discoloration, or imperfections in plaster, gunite, or fiberglass
Contractor is not responsible for pre-existing conditions or issues that become visible during or after service. Minor cosmetic imperfections are normal and not considered defects.
10. Warranty
- Workmanship: 1 year from completion
- Liner: Up to 3 years (as applicable), then manufacturer warranty
- Equipment/Materials: Covered by manufacturer warranties only
- Warranty is void if account is not paid in full.
- Warranty does not cover damage caused by: Improper maintenance or chemical imbalance, Groundwater, drainage, or soil movement, Draining the pool, Acts of God or external conditions
11. Cancellation & Changes: Customer may cancel within 3 business days of signing without penalty.
Any changes to scope must be approved in writing and may result in additional costs and schedule adjustments. Cancellations after the allowed period may be subject to incurred costs and fees.
12. Limitation of Liability
Contractor’s liability is limited to the amount paid for the specific service performed. Contractor is not responsible for indirect, incidental, or consequential damages, including loss of use or property damage.
Customer assumes all risks associated with pool ownership and operation.
13. Legal & Enforcement: Customer agrees to reimburse Contractor for reasonable legal and collection costs in the event of non-payment or breach of contract. These Terms are governed by the laws of the State of New York and supersede all prior agreements or representations.
14. Acceptance of Agreement: Approval of any estimate, proposal, or invoice constitutes acceptance of these Terms & Conditions and authorizes Contractor to perform the work as specified.
